PRIVILEGED AND NON-PRIVILEGED DOCUMENTS – By @MissPearls

In her judgment, Justice Nancy Maldonado mentioned that Nigeria’s President Bola Tinubu’s Privileged documents CAN’T be released to former Vice President  Atiku Abubakar.

So, what are Privileged and Non-Privileged Documents?

Come with me….

Non-Privileged Document means documents and records, whether hard copy or electronic, which are NOT subject to any legal privilege preventing its discovery and/or disclosure in a legal proceeding. These can be released.

Privileged Documents means all documents and communications maintained by the debtors and subject to attorney-client, work product, or common interest privilege claims

For instance, if Tinubu was owing his school fees or he had a conversation with a lawyer while he was in school, and it’s documented, such CAN’T be disclosed as they are privileged documents.

If Tinubu had conversations with the CIA or federal agents while he was  in school that borders on national security and it is documented, then they are privileged documents and CAN’T be released.

Any other document that falls outside of these are Non-Privileged documents and ALL of them must be released according to the judgement.

And, there’s absolutely NOTHING  to worry about. All the necessary documents requested by Atiku are part of what the judge ordered to be released. So we good!

DopeReporters recalls that the United States Court had ordered the Chicago State University (CSU) to release President Bola Tinubu’s academic records to former Vice President Atiku Abubakar by Tuesday.

Justice Maldonado of the Northern District of Illinois upheld the September 20 ruling of US Magistrate Judge, Jeffery Gilbert, who ordered the CSU to release Tinubu’s academic records as requested by Atiku, stressing that the PDP candidate Atiku had the right to have access to the records.

The presiding judge, Nancy Maldonado, dismissed Tinubu’s objection, issuing a two-day ultimatum to CSU to release the documents to Atiku.

Abubakar, the presidential candidate of the main opposition Peoples Democratic Party (PDP) had approached the US District Court in Northern Illinois to compel the university to release Tinubu’s academic records, arguing that it would boost his suit challenging the President’s election in the February 25 presidential poll.

The PDP candidate had requested the documents for use in Nigerian courts to support his argument that Tinubu forged a certificate he claimed to have obtained from CSU in 1979 and submitted to Nigeria’s electoral body, the Independent National Electoral Commission (INEC), for the 2023 presidential election.
