Three men Oto-Obong Enefiok, Emmanuel Henshaw and Nasiru Saliu, were on Wednesday arraigned before the Ebute-Metta Magistrate Court, in Lagos for allegedly stealing N46.5m, from a company.
Enefiok 49, Henshaw 47 and Saliu 58, were arraigned before Magistrate Mrs Folarin Williams.
The defendants whose addresses were not given are facing three counts bordering on conspiracy, obtaining, fraud, diversion, and stealing preferred against them by the police.
The police prosecutor, Supol Stephen Molo, told the court that the defendants committed the alleged offences with others now at large.
He told the court that the offences occurred on April 30, 2024.
Molo said the trio fraudulently obtained N6.5m from Rena Africa, located at No 6, Rosenje Street Gbagada, Lagos State.
The prosecutor also told the court that the defendants stole 35 tons of fertiliser valued at N40m, by diverting it.
According to the prosecutor, the offences committed are punishable under Sections 411, 314 and 287 (9) of the Criminal Laws of Lagos State 2015.
However, the defendants pleaded not guilty to the charges against them.
The defendants’ lawyer, Rotimi Komolafe, who represented the second and third defendants, urged the court to grant the defendants bail in the most liberal terms.
He said, “I humbly apply that bail be granted to the second and third defendants in most liberal terms.”
Consequently, Magistrate Williams granted the defendants bail in the sum of N3m each and two sureties each in like sum.
She ordered that the sureties must show evidence of tax payment to the Lagos State Government and that one of the sureties must be on a managerial level.
