An Ado-Ekiti Magistrate court on Wednesday remanded a Lagos-based human rights lawyer, Dele Farotimi over an alleged case of defamation against Aare Afe Babalola (SAN).
Farotimi, who was arrested at his chamber in Lagos on Tuesday by officers from Ekiti State Police Command, was arraigned for allegedly publishing a book “Nigeria and its Criminal Justice System where he alleged that Aare Afe Babalola corrupted the Judiciary and procured judgements in the supreme court.
Babalola, founder of Afe Babalola University alleged that the book by Farotimi exposed him to hatred, contempt and ridicule and damaged his hard-earned career.
The suspect, Farotimi pleaded not guilty to all the sixteen count charges.
Police prosecutor, Samson Osun called for the remand of the suspect in prison custody pending further investigation and its outcome for the maintenance of security in the country.
Counsel to the defendant, Dayo Akeredolu opposed the remand call and pleaded with the court to admit the defendant to bail on very liberal terms and on self-recognition because the case at hand is bailable and the suspect is a known figure who is not constituting any threat .
He said the defendant is presumed innocent until proven guilty.
In his ruling, the presiding Magistrate, Abayomi Adeosun remanded the suspect in prison custody and adjourned hearing till December 10.

Human rights lawyer and activist, Dele Farotimi has been remanded in prison for allegedly defaming a legal luminary and founder of Afe Babalola University, Aare Afe Babalola, SAN.
DAILY POST earlier reported that Farotimi was arraigned before a Magistrate Court in Ado Ekiti on Monday.
The activist was accused of maligning and defaming the character of Afe Babalola in his recently published book, ‘Nigeria and Its Criminal Justice System.
Farotimi pleaded not guilty to all the sixteen count charges.

Human rights lawyer and activist, Dele Farotimi, has been arraigned before an Ekiti State Magistrate Court.

Nigerian human rights lawyer Dele Farotimi has reportedly been arrested by the Nigeria Police Force.
According to reports, Farotimi’s arrest on Tuesday followed a petition filed by Tony Elumelu of UBA Group, accusing the lawyer of defamation.
Omoyele Sowore, a 2023 presidential candidate of the African Action Congress (AAC), hinted at Farotimi’s arrest in a post on his official X handle on Tuesday.
He wrote: “I just learned that Dele Farotimi was arrested by the Nigerian Police over a petition by Tony Elumelu of UBA Group alleging Dele defamed him. It is pertinent that the Nigerian police are notified that the institution cannot continue to be used to settle personal scores, and we, the citizens of Nigeria, would no longer tolerate such a situation. Therefore, the police at Zone 2 in Lagos are advised to release Barrister Dele Farotimi immediately.”
Farotimi previously alleged that officers of the Nigeria Police Force have developed a plan to abduct him in Lagos.
He accused the police of using deceptive methods to lure him into custody, despite his willingness to honor an invitation to the Zone 2 police headquarters in Lagos.
According to reports, Farotimi made this claim during a press conference on Monday. The public affairs analyst revealed that the police’s actions are in response to a petition reportedly filed by Afe Babalola, a Senior Advocate of Nigeria (SAN).
On Monday, the 11th of November 2024, I was informed that an invitation letter from Zone 2 police command was delivered to my office,” he said.
“The letter requested that I report to the station on Wednesday, the 13th of November 2024, at 10:00 AM.
“Accompanied by my legal counsel, I arrived at the station at 9:45 AM on the stated date.
“At the station, I was presented with a petition written by a lawyer on behalf of Mr. Tony Elumelu, accusing me of defamation.
The Social and Economic Rights Accountability Project, SERAP, has called on President Bola Tinubu’s administration to release activist Dele Farotimi.
SERAP cautioned the Nigerian government against using criminal defamation laws to turn critics into criminals.
Posting on X, SERAP wrote: “BREAKING: The Tinubu administration must immediately release activist Dele Farotimi who is reportedly arrested for alleged defamation.
“Nigerian authorities should not be using criminal defamation laws to turn critics into criminals and undermine freedom of expression.”
Earlier, DAILY POST reports a petition written by Chief Afe Babalola, Senior Advocate of Nigeria, accusing him of defaming his client.
The arrest comes amidst ongoing tensions, with Farotimi previously raising concerns over alleged threats to his life by influential figures within Nigerian elite circles, purportedly in collaboration with security agencies and legal professionals.
On her part, Aisha Yesufu wondered when the police would stop being a weapon of oppression.
“What the heck is going on? Mr Dele Farotimi @DeleFarotimi arrested by police and whereabouts unknown? @PoliceNG when will you stop being a weapon of oppression?
“They want to silence voices #FreeDeleFarotimiNow,” she wrote.
